Terms and conditions of VSC Consulting- und HandelsgmbH for METHOD>SELLING (English)



1. Introduction


The following are the terms and conditions of VSC Consulting und HandelsgmbH, Oberwiedenstrasse 30/190, Vienna 1170, Austria.

Therein after known as VSC for purposes of these terms and conditions. METHOD>SELLING is an international negotiation and sales training. 


2. Customers


The website and commercial materials of VSC are aimed at and apply to both private and commercial customers and user hereinafter simply referred to as the Customer in these terms and conditions.


3. Products


METHOD>SELLING programmes and services are on website www.method-selling.com.


4. Needs analysis


We offer each Customer a needs analysis without charge at its place of business Oberwiedenstrasse 30/190, 1170 Vienna. This is booked by appointment with office@method-selling.com The consultation can be conducted over Skype or by personal appointment. The needs analysis is the opportunity for the customer to ask questions about program content, English language, organisation and how they and/or their company benefits with METHOD>SELLING, before they book the program. Any additional points may be included in the quotation. After ordering the Customer will receive from VSC the relevant materials to prepare for the program.


5. Price quotations


All prices are quoted in Euro excluding VAT at 20% according to the products and services offered by VSC at the time of the Customer order. Only a legally authorised signatory of HJK is able to quote legally binding prices and conditions on behalf of VSC. All quotations will be written. Quotations include preparation work, programme description, location and dates.


6. Additional charges


VSC charges the Customer for travel and accommodation outside Vienna or London respectively. Expenses depending on the individual project made on behalf of the Customer are agreed before the order confirmation between HJK and the Customer. This budget is agreed in advance of the Customer commissioning or paying for any work.


7. Ordering


The order becomes valid for any product or service of VSC once the User confirms by email, letter, fax, sms or any digital message service they agree to purchase according to the quoted conditions stated by VSC in writing according to points 5 and 6.


When the Customer confirms the order according to above provisions the order becomes legally binding according to these General terms and conditions.


The order made by the Customer is confirmed once VSC sends a confirmation e-mail or letter addressed to the Customer making the order for his or her private consumption or on behalf of a commercial organisation.


For special seminars held at hotels the Customer will receive information regarding the cost of accommodation and meals.

It is the responsibility of the Customer to pay for their own accommodation and meals at the seminar hotel where the METHOD>SELLING programme takes place 30 days in advance.


8. Payment terms


7 sessions


Payment for any METHOD>SELLING 7 sessions programme is due before the first day of the programme. This is to cover time for organising and preparing materials and arranging venues and facilities. All Prices are quoted exclusive of VAT.


Savile row


Payment for METHOD>SELLING Savile Row programme is 100 % before the agreed sessions. No weekend surcharge is made.

10. Cancellation


In cases when a Customer cannot attend a session/s of METHOD >SELLING the Customer is obliged  to inform VSC of cancellation by 14.00 hrs on the business day before the session starts. In the case of being unable to attend on a Monday the Customer is obliged to inform VSC on Friday by 14.00hrs. VSC will arrange an alternative programme time with the Customer The standard procedure is for the Customer to call METHOD>SELLING on +43 (0) 660 616 8105 and send a short message to office@method-selling.com.


All sales training and consultancy appointments are subject to availability of the Trainer and Consultant. In the case where a Trainer or Consultant is not available VSC will offer the Customer a full refund for the specific training and consultancy time that had to be cancelled or the opportunity for a rescheduled training or consultancy appointment. VSC is obliged to inform the Customer of cancellation by 14.00hrs the day before the session starts. In the case of being unable to attend on a Monday VSC is obliged to inform the Customer on Friday by 14.00hrs. VSC will arrange an alternative appointment with the Customer.


11. Liability


VSC is not liable for loss or damage to items brought by customers to their training, meetings and events or in cases where the customer is unable to attend sessions owing to lateness. Customers are advised to keep valuables with them at all times. VSC is not responsible for the commercial transactions of the Customer, the learning capacity of a Customer or paying for any travel, subsistence or accommodation costs.


9. Certificate of completion


All Customers of METHOD>SELLING receive a certificate of completion after finishing all of the sessions of the agreed programme. The certificate states the dates of participation, the titles of the sessions and is signed by the authorized signatories of METHOD>SELLING. 


12. Confidentiality


Throughout the duration of the METHOD>SELLING program and 24 months after completion of the last training program the Customer may not contact the persons engaged or employed by VSC with the intention of asking them to provide the same or similar style type of training or gain competitive information about the METHOD>SELLING training program. HJK will demand compensation from any customer who violates this prohibition, equal to the total gross remuneration of the relevant employees and the amount the contract partner paid over the last twelve months.


Any confidential information can only be shared with the written authorisation of the signatories of VSC. All customer information remains striclty confidential and may not be used or shared during or after a course for whatever reason by VSC employees: unless agreed in writing by the Customer.


13. Intellectual property and copyright


All learning materials provided by VSC and given to the Customer for METHOD >SELLING sessions must remain confidential and may not be re produced, given out on loan, or transferred digitally to another party for whatever reason during and after the training program. The copyright of METHOD>SELLING is registered. Any third party use of METHOD>SELLING copyright names and materials requires the written approval from VSC, who is responsible for the worldwide distribution and marketing of the METHOD>SELLING brand. Any resemblance to a person or event during the training sessions is purely co-incidental.


14. Jurisdiction


In the case where common sense solutions cannot resolve disputes regarding the execution, interpretation or application of these terms and conditions for METHOD>SELLING. The place of jurisdiction is Vienna, Austria These terms and conditions are governed by Austrian law and customers agree to submit to the exclusive jurisdiction of the Austrian courts.
